3. Health, safety, and educational disclaimer

We provide educational information about managing flight-related anxiety. We do not provide medical, psychological, or therapeutic care, and the Services are not a substitute for professional advice, diagnosis, or treatment. Always seek the advice of a physician or qualified mental health professional with questions about a medical or psychological condition. If you are in crisis or think you may have an emergency, call your local emergency number.

 The Services are not flight training and do not replace instructions from airlines, regulators, air crew, or airport authorities.

4. Accounts

If you register an account, you agree to provide accurate information, keep it updated, and maintain the confidentiality of your credentials. You are responsible for all activity under your account.

5. Purchases, pricing, taxes, refunds

Pricing and currency. Prices are shown in U.S. dollars unless stated otherwise.

Taxes. We may collect applicable taxes (including U.S. sales/use taxes) where required by law.

Subscriptions. If an offering is subscription-based, you authorize recurring charges until you cancel. You can cancel future renewals at any time as described at checkout or in your account.

If a specific offer page states a different policy, that policy controls for that purchase.

 Trials and promotions. Trials convert to paid plans unless canceled before the trial ends. We may modify or end promotions at any time.

13. Limitation of liability

To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, revenues, goodwill, data, or other intangible losses, arising out of or relating to your use of or inability to use the Services. Our total liability for any claim arising out of or relating to the Services will not exceed To the maximum extent permitted by law, our total aggregate liability arising out of or related to a purchase will not exceed the greater of USD 50 or the price you paid for that product. You agree to indemnify, defend, and hold harmless Alpha Services and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or violation of these Terms.

15. Export control and sanctions

You agree to comply with all applicable export control and sanctions laws of the United States, the European Union, and France, and not to use the Services in prohibited jurisdictions or for prohibited purposes.

16. Governing law; dispute resolution; class-action waiver

Choice of law. These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation are governed by the laws of France, without regard to conflict-of-laws principles.

Binding arbitration. Any dispute arising out of or relating to these Terms or the Services will be finally resolved by arbitration administered by ICC International Court of Arbitration (International Chamber of Commerce). The seat/place of arbitration will be Paris, France. The arbitration will be conducted in French by a single arbitrator, and the arbitral award may be entered in any court of competent jurisdiction.

Exceptions. Either party may: (a) seek injunctive relief to protect intellectual property or prevent unauthorized access or misuse; and (b) bring an individual claim in a court of competent jurisdiction for non-arbitrable consumer matters where such right cannot be waived under applicable law.

Class-action waiver (to the extent permitted by law). You and we agree that each may bring claims only in our individual capacities and not as a plaintiff or class member in any purported class or representative proceeding.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing rod@zerofeartakeoff.com with your full name and a clear statement that you opt out.

(If you prefer a U.S. forum instead, switch this clause to JAMS/AAA with New York or Delaware law. Pick one scheme and keep it consistent across your policies.)

17. Termination

We may suspend or terminate access to the Services at any time, including if you violate these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and dispute resolution).

We may modify the Services and these Terms at any time. If we make material changes, we will provide notice (e.g., by posting the updated Terms and updating the Effective Date). Your continued use after changes become effective constitutes acceptance.

19. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
